PuraThis document forms a binding agreement between you ("Creator", "you") and [Pura Technologies Oy] ("Pura.fan", "we", "us"). By creating a creator account and using our services, you agree to the terms below.
1. The Creator Agreement
1.1. Independent Contractor Status
You are an independent contractor. Nothing in this agreement creates a partnership, joint venture, agency, or employment relationship between you and Pura.fan. You have the sole right to control the manner, means, and content of your creative work.
1.2. Platform Fees & Payouts
- Platform Fee: Pura.fan charges a transparent fee of 3% to 7% per transaction, determined by the cryptocurrency used by the fan and current network congestion. There are no hidden withdrawal fees.
- Payout Mechanics: Payouts are processed daily. A minimum balance of $1.00 USD (or equivalent) is required to trigger a payout.
- Payout Currencies: You may select your preferred payout cryptocurrency from our available options (currently including XMR, LTC, USDC on Polygon, and USDC on Solana). While fans can pay in any supported coin, you will receive your net earnings in your chosen payout coin.
- Price Stability: Your dashboard balance is calculated and displayed in a stable fiat equivalent (e.g., USD) to protect you from crypto volatility, though the actual crypto amount you receive will reflect the exchange rate at the time of payout.
1.3. Intellectual Property & Content Ownership
- You Own Your Content: You retain 100% ownership and copyright of all content you upload to Pura.fan.
- License to Platform: By uploading content, you grant Pura.fan a limited, non-exclusive, worldwide license to host, display, and distribute your content solely for the purpose of operating the Platform and delivering it to your paying subscribers.
- Platform Protection: We respect creator rights. As we grow, we intend to actively assist creators by issuing DMCA takedown notices against third-party sites that steal your content.
1.4. The "Neutral Platform" & Marketing
Pura.fan does not use algorithmic feeds, discovery engines, or content promotion. Your content
lives on your specific subdomain (e.g., username.pura.fan). You are solely responsible for marketing your page and driving your own traffic. We do not guarantee any level of traffic, subscribers, or income.
2. Age Verification & Content Compliance
2.1. Strict 18+ Requirement
You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an account. Furthermore, every individual depicted in your content must be at least 18 years old.
2.2. Verification Without KYC
Pura.fan is a privacy-first platform and does not require government ID (KYC) to create an account. Therefore, age verification operates on an honor system and self-declaration.
- By creating an account, you legally attest that you are 18+ and that all individuals in your content are 18+.
- Creator's Record Keeping: If you produce sexually explicit content, you are solely responsible for maintaining your own age and consent records (e.g., 18 U.S.C. § 2257 records, if applicable in your jurisdiction). You must provide these records to Pura.fan only if we are legally compelled by a valid court order or law enforcement request.
2.3. Link Sharing Responsibility
Because we do not have an algorithmic feed, we do not distribute your content to the general public. However, if you share your Pura.fan URL on external social media, you are responsible for ensuring those external platforms' age-gating rules are followed. Pura.fan is not liable for how you distribute your link.
3. Tax Compliance
3.1. Sole Responsibility for Taxes
As an independent contractor, you are solely responsible for calculating, reporting, and paying all income, self-employment, and other taxes associated with your earnings on Pura.fan, according to the laws of your local jurisdiction.
3.2. No Tax Forms Issued
Pura.fan is a global, pseudonymous platform. We do not issue tax forms (such as 1099s in the US or equivalent documents elsewhere). It is your responsibility to track your own earnings and expenses.
3.3. Cryptocurrency Tax Implications
You acknowledge that receiving payouts in cryptocurrency may trigger taxable events (such as capital gains or income tax) in your jurisdiction at the time of receipt or conversion. We strongly recommend consulting a local tax professional.
4. General Disclaimers & Limitation of Liability
4.1. "AS IS" and Alpha Status
Pura.fan is currently in an Alpha testing phase. The Platform, its software, and its services are provided strictly on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee 100% uptime, bug-free operation, or uninterrupted service. We reserve the right to pause the platform for maintenance at any time.
4.2. No Earnings or Success Guarantee
Using Pura.fan does not guarantee that you will make any money. Your success depends entirely on your audience, your content, and your marketing efforts. We make no promises regarding your potential earnings.
4.3. Limitation of Liability
To the maximum extent permitted by law, Pura.fan, its operators, and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of data, loss of cryptocurrency, or business interruption. Our total aggregate liability to you for any claim arising out of your use of the platform shall not exceed the total amount of platform fees we collected from your account in the three (3) months preceding the claim.
4.4. Third-Party Payment Gateways
Pura.fan uses third-party payment processors to facilitate crypto transactions. We are not liable for the failures, delays, freezes, or policy changes of these third-party gateways. If a gateway freezes funds, our liability is limited to cooperating with you to resolve the issue with the gateway.
4.5. No Professional Advice
Nothing on Pura.fan constitutes legal, financial, tax, or investment advice. You should consult with qualified professionals regarding your specific legal and financial situation.
