1. Our Commitment to Intellectual Property
Pura.fan respects the intellectual property rights of others and expects all users of our Platform to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and equivalent international "notice and action" frameworks (such as the EU Digital Services Act), we will respond promptly and appropriately to claims of copyright infringement.
As a neutral platform, Pura.fan does not proactively monitor user-uploaded content for copyright violations. However, we rely on copyright holders and their authorized agents to notify us of alleged infringements so we can take swift action.
2. How to Report Copyright Infringement (Takedown Notice)
If you believe that your copyrighted work has been copied and is accessible on Pura.fan in a way that constitutes copyright infringement, please submit a formal takedown notice to our designated Copyright Agent at:
Email: pura.fan@atomicmail.io
Subject line: DMCA Takedown Notice: [Infringing URL or Username]
To be valid and actionable, your notice must include all of the following information:
- Identification of the Copyrighted Work: A clear description of the original copyrighted work you claim is being infringed (e.g., links to your original website, social media, or registered work).
- Identification of the Infringing Material: The specific URL(s) on Pura.fan
(e.g.,
username.pura.fan/post/123) where the allegedly infringing material is located, so we can find and remove it. - Your Contact Information: Your full legal name, physical address, telephone number, and a valid email address.
- Good Faith Statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy Statement: A statement, made under penalty of perjury, that the information in the notification is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner.
- Physical or Electronic Signature: The signature of the person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
Note: Incomplete notices may delay our ability to process your request.
3. Our Response Timeline & Action
We take copyright protection seriously. Upon receiving a valid and complete takedown notice:
- We will review the notice promptly.
- We commit to removing or disabling access to the allegedly infringing content within 24 hours to 3 days of receiving a valid notice.
- We will notify the affected creator that their content has been removed due to a copyright claim, providing them with a copy of the notice (with your personal contact information redacted for your privacy).
4. Counter-Notice Procedure (For Creators)
We also fiercely protect our creators from false or mistaken claims. If you are a creator and you believe your content was removed due to a mistake or misidentification, you have the right to submit a Counter-Notice.
To submit a Counter-Notice, email pura.fan@atomicmail.io with the subject line "DMCA Counter-Notice: [Your Username]" and include:
- Your full legal name, address, phone number, and email.
- Identification of the material that was removed and the URL where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the courts in Finland (or your local jurisdiction), and that you will accept service of process from the person who provided the original takedown notice.
- Your physical or electronic signature.
Upon receiving a valid Counter-Notice, we will forward it to the original complainant. If the complainant does not notify us within 10–14 business days that they have filed a legal action to restrain the creator from engaging in the infringing activity, we may, at our discretion, restore the removed content.
5. Repeat Infringer Policy
In accordance with the DMCA and our Terms of Service, Pura.fan maintains a strict Repeat Infringer Policy. We reserve the right to terminate the accounts and access to the Platform of any user who is determined to be a repeat infringer of copyrighted materials. A "repeat infringer" is generally defined as a user who has received multiple valid takedown notices.
6. Warning Against False Claims
Submitting a false or fraudulent DMCA takedown notice can result in legal liability, including damages and legal fees, under laws such as 17 U.S.C. § 512(f) of the DMCA. If you are unsure whether material on the Platform infringes your copyright, we strongly recommend seeking legal advice before submitting a notice. We do not tolerate the abuse of this process to harass creators or stifle legitimate fair use.
