1. Acceptance of Terms & Alpha Disclaimer

Welcome to Pura.fan ("Platform", "we", "us", or "our"), operated by [Pura Technologies Oy].

IMPORTANT ALPHA DISCLAIMER: Pura.fan is currently in an Alpha testing phase. The Platform is provided "AS IS" and "AS AVAILABLE". While we strive for high reliability, you acknowledge that Alpha software may contain bugs, errors, or incomplete features, and may be subject to unexpected downtime, data loss, or changes. By accessing or using Pura.fan, you agree to these Terms of Service ("Terms"). If you do not agree, you must not use the Platform.

2. Platform Description & Philosophy

Pura.fan is a privacy-friendly, crypto-native platform that allows creators to share exclusive content with fans via cryptocurrency subscriptions.

  • No Algorithms, No Feeds: We do not use recommendation algorithms, discovery feeds, or content promotion. Creators operate on independent subdomains (e.g., placeholder.pura.fan).
  • Neutral Platform: We do not cherry-pick, promote, or endorse any specific content. We are not responsible for how users share or distribute their subdomain URLs outside the Platform.
  • Pseudonymity: We support anonymous and pseudonymous accounts. You may create multiple accounts to separate your personal and creative lives.

3. Eligibility & Age Requirement

You must be at least 18 years old (or the age of legal majority in your jurisdiction, whichever is higher) to use Pura.fan. By creating an account, you represent and warrant that you meet this age requirement. We rely on an honor system and self-declaration for age gating; however, any attempt to circumvent this or host underage content will result in immediate, permanent termination and reporting to relevant authorities.

4. Acceptable Use & Content Policies

Prohibited Content & Behavior (Zero Tolerance):

  • Illegal activities or content, including but not limited to the unauthorized distribution of restricted media.
  • Child Sexual Abuse Material (CSAM) or any content depicting minors in explicit situations.
  • Non-consensual intimate imagery (NCII) or "revenge porn."
  • Incitement of violence, harassment, defamation, or libel.
  • Doxxing or sharing private/confidential information of others without consent.
  • Discrimination based on faith, ethnicity, sexual orientation, sex, gender expression, disability, or age.

Adult/NSFW Content:

Adult content is permitted but must be strictly labeled and age-gated. It must comply with standard acceptable-use frameworks: no bestiality, no non-consensual acts, no extreme violence, and no illegal acts.

Moderation Approach: We utilize a hybrid moderation model. New profiles may undergo initial review. Once trust is established, moderation becomes primarily reactive. We do not use automated content-scanning AI (Yet). Reports can be submitted via email, and we are developing an in-platform reporting form.

5. Fees, Payments & Payouts

  • Platform Fee: We charge a transparent fee of 3% to 7% per transaction, depending on the cryptocurrency used and network congestion (e.g., examples: ~3% for Polygon, ~7% for Bitcoin/TRC20, etc). There are no additional withdrawal fees charged by the Platform.
  • Supported Cryptocurrencies: The list of supported coins is displayed on our main page (17) and is subject to change as we upgrade our payment infrastructure.
  • Creator Payouts: Creators can select their preferred payout currency from available options (currently including XMR, LTC, USDC on Polygon, and USDC on Solana, with more to come). Fans may pay using any supported coin, but creators receive payouts in their chosen currency.
  • Balance & Stability: Creator balances are displayed and stabilized in USD (other options will be enabled in future, such as EUR) to protect against crypto volatility.
  • Minimum Payout: A minimum balance of $1.00 USD is required to initiate a payout.

6. Transaction Facilitation & Crypto Risks

  • Not a Financial Institution: Pura.fan is a technology platform, not a bank, wallet provider, or money transmitter. We facilitate transactions via third-party payment gateways. Balances shown are "account credits" for Platform use, not legal tender deposits.
  • Crypto Nature: Cryptocurrency transactions are irreversible. If you send funds to an incorrect wallet address, the Platform cannot recover them, and the loss is solely your responsibility.
  • Failed Transactions: If a transaction fails or stalls due to Platform or gateway errors, our support team will manually investigate and resolve the issue in good faith.

7. Intellectual Property & Content Rights

  • Creator Ownership: You retain 100% full ownership of all content you upload to Pura.fan.
  • Limited License: By uploading content, you grant Pura.fan a limited, non-exclusive, revocable, worldwide license to host, store, and display your content solely for the purpose of operating and providing the Platform to your subscribers.
  • Creator Protection: As we grow, we aim to actively protect our creators by issuing DMCA takedown notices on their behalf against platforms that steal their content.

8. Copyright & DMCA Policy

We respect intellectual property rights. If you believe your copyrighted work has been copied and is accessible on Pura.fan in a way that constitutes copyright infringement, please notify us at pura.fan@atomicmail.io. We process and respond to valid DMCA takedown requests within 24 hours to 3 days.

9. Privacy & Data Collection

We are committed to minimal data collection:

  • We do not require or collect personal email addresses for basic functionality.
  • If IP addresses are logged for security, they are hashed and anonymized. (except NGINX web server - http://nginx.net/)
  • We may store transaction invoice IDs or hashes solely for accounting and dispute resolution.
  • Data is retained only as long as necessary to provide the service, resolve disputes, or comply with applicable laws, after which it is securely deleted.
  • We do not use third-party analytics or tracking services. We only utilize secure, standard cloud infrastructure providers for hosting and media storage (e.g., S3-compatible storage, CDN).

10. Dispute Resolution & Limitation of Liability

  • User Disputes: Pura.fan is not responsible for disputes between creators and fans (e.g., dissatisfaction with content). However, if a fan pays and does not receive access due to a Platform error, we will investigate in good faith and may facilitate a resolution or refund, provided it does not unfairly penalize the creator for a Platform-side fault.
  • Limitation of Liability: To the maximum extent permitted by law, Pura.fan and its operators shall not be liable for any indirect, incidental, or consequential damages, including loss of data, profits, or crypto assets resulting from user error, network failures, or gateway issues.

11. Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, particularly regarding prohibited content. Depending on the severity, this may occur with or without prior warning. Users may appeal termination decisions by contacting support.

12. Modifications to Terms & Platform

The Platform is constantly evolving. We reserve the right to modify these Terms, fees, or features at any time. Changes will be effective immediately upon posting to the Platform. Continued use of Pura.fan after changes constitutes acceptance. We will notify users of significant changes via our official Telegram community.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts located in Finland.
